1. Seller
Jonathan FIORI, sole trader (entrepreneur individuel, EI), trading as Nidouillet, 18 avenue Gabriel Péri, 83160 La Valette-du-Var, France. SIRET 904 958 816 00020. Email: novalya.entreprise@gmail.com. VAT not applicable, article 293 B of the French General Tax Code.
2. Scope
These general terms and conditions of sale (CGV) apply to any order placed on nidouillet.fr by a consumer. They are accepted by the customer when placing the order. The applicable version is the one online on the date of the order.
3. Products
The products offered are nursing pillows and their accessories. Their essential characteristics (dimensions, composition, set contents, patterns) are described on each product page. The photos are as accurate as possible; slight differences in colour may occur depending on the screen.
The nursing pillow is a comfort accessory for the parent during breastfeeds and bottle feeds. It is not a sleeping surface: never let your baby sleep on it or leave them on it unattended.
4. Prices
Prices are shown in euros, all taxes included (VAT not applicable, article 293 B of the French General Tax Code). Any delivery charges are shown before the order is confirmed; delivery is free in France. The applicable price is the one displayed at the time of ordering.
5. Ordering
The customer chooses their products, adds them to the basket, enters their contact details and delivery address, chooses a payment method and then confirms the order. Before paying, they can check the details and total price of their order and correct any errors. The sale is concluded upon confirmation of payment; a summary email is then sent to the customer.
6. Payment
Payment is made online, at the time of ordering, using the methods offered at checkout. Transactions are secured by our payment provider; we never have access to your bank details.
7. Delivery
Delivery times and conditions are detailed in our shipping policy (nidouillet.fr/en/pages/livraison). In France, delivery is free and tracked, and normally takes place within 5 to 11 working days. Unless another date has been agreed, delivery takes place no later than 30 days after the order. Failing this, the customer may, after asking us to deliver within a reasonable additional period that has passed without delivery, cancel the order and be refunded (articles L216-1 et seq. of the Code de la consommation, the French Consumer Code).
8. Right of withdrawal
The customer has 14 days from receipt of the product to withdraw, without having to give any reason. The procedure and the withdrawal form are set out in our returns and withdrawal policy (nidouillet.fr/en/pages/retours).
9. Legal guarantees
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them. If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if: 1° the trader refuses to repair or replace the goods; 2° the repair or replacement of the goods takes place after a period of thirty days; 3° the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; 4° the lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to request repair or replacement of the goods first. The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered. The rights mentioned above result from the application of articles L217-1 to L217-32 of the Code de la consommation. A seller who, in bad faith, obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L241-5 of the Code de la consommation).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the Code civil (French Civil Code), for a period of two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.
For any claim under these guarantees, write to us at novalya.entreprise@gmail.com, including your order number and, if possible, photos.
10. Personal data
The data collected when you place an order is used to process and deliver it. How it is processed is described in our privacy policy (nidouillet.fr/en/policies/privacy-policy).
11. Complaints and mediation
Any complaint may be sent to novalya.entreprise@gmail.com or by post to the seller's address. We undertake to reply as quickly as possible. In accordance with articles L611-1 et seq. of the Code de la consommation, if a dispute remains unresolved, the customer may refer it free of charge to a consumer mediator.
12. Governing law
These CGV are governed by French law. In the event of a dispute, and failing an amicable solution, the French courts have jurisdiction, without prejudice to the protective rules from which the consumer benefits.
