1. Seller
Jonathan FIORI, sole trader (entrepreneur individuel, EI), trading as Nidouillet, 18 avenue Gabriel Péri, 83160 La Valette-du-Var, France. SIRET 904 958 816 00020. Email: contact@nidouillet.fr. VAT not applicable, article 293 B of the French General Tax Code.
2. Scope
These terms and conditions of sale apply to every order placed on nidouillet.fr by a consumer. The customer accepts them when placing the order. The applicable version is the one online on the date of the order.
3. Products
The products offered are nursing pillows and their accessories, and a hands-free baby bottle. Their essential characteristics (size, composition, contents, patterns) are described on each product page. Photos are as accurate as possible; slight differences in colour may appear depending on your screen.
The nursing pillow is a comfort accessory for the parent during breastfeeding and bottle-feeding. It is not a bed: never let your baby sleep on it or leave baby unattended.
4. Prices
Prices are shown in euros, all taxes included (VAT not applicable, article 293 B of the French General Tax Code). Any delivery costs are shown before the order is confirmed; delivery is free in France. The applicable price is the one displayed when the order is placed.
5. Ordering
The customer chooses products, adds them to the cart, enters their contact details and delivery address, chooses a payment method and confirms the order. Before paying, they can check the details and total price of the order and correct any mistakes. The sale is concluded when payment is confirmed; a summary email is then sent to the customer.
6. Payment
Payment is made online when ordering, using the methods offered at checkout. Transactions are secured by our payment provider; we never have access to your bank details.
7. Delivery
Delivery times and conditions are detailed in our delivery policy. In France, delivery is free, tracked, and normally takes 5 to 11 working days. Unless another date is agreed, delivery takes place no later than 30 days after the order. Otherwise, after asking us to deliver within a reasonable additional period that has passed without delivery, the customer can cancel the order and be refunded (articles L216-1 et seq. of the French Consumer Code).
8. Right of withdrawal
The customer has 14 days from delivery of the product to withdraw, without giving any reason. The procedure and the withdrawal form are set out in our returns and withdrawal policy.
9. Legal guarantees
The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to prove that the lack of conformity exists, not when it appeared.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience. If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer asks for a repair but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date the goods are replaced.
The consumer may obtain a price reduction while keeping the goods, or end the contract and receive a full refund by returning the goods, if: 1) the seller refuses to repair or replace the goods; 2) the repair or replacement takes place after thirty days; 3) the repair or replacement causes the consumer major inconvenience, in particular when the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods; 4) the goods remain non-conforming despite the seller's unsuccessful attempt to bring them into conformity.
The consumer is also entitled to a price reduction or to terminate the contract when the lack of conformity is so serious that an immediate price reduction or termination is justified. The consumer is then not required to ask for repair or replacement first. The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered. The rights above result from articles L217-1 to L217-32 of the French Consumer Code. A seller who in bad faith obstructs the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee gives the right to a price reduction if the goods are kept, or to a full refund if they are returned.
For any request under these guarantees, write to us at contact@nidouillet.fr with your order number and, if possible, photos.
10. Personal data
Data collected when ordering is used to process and deliver the order. How it is processed is described in our privacy policy.
11. Customer reviews
Reviews published on this website are submitted by customers who have placed an order, invited by email after shipping. Every review is read before publication. A review may be refused only if it contains insulting, defamatory or discriminatory content, personal data or advertising, or if it does not concern the product purchased. Negative reviews are not rejected for that reason alone. To thank customers for their time, the email inviting them to leave a review contains a 20% discount code for a future order, usable whether or not they leave a review and whatever the rating. Reviews are displayed from newest to oldest. The author of a refused review is informed by email.
12. Complaints and mediation
Any complaint can be sent to contact@nidouillet.fr or by post to the seller's address. We undertake to reply as quickly as possible. In accordance with articles L611-1 et seq. of the French Consumer Code, if a dispute is not resolved, the customer may use a consumer mediator free of charge.
13. Applicable law
These terms and conditions are governed by French law. In the event of a dispute, and failing an amicable solution, the French courts have jurisdiction, without prejudice to the protective rules that benefit the consumer.
